Terms of sale
1. GENERAL
These General Terms and Conditions of Sale (GTC) apply to all orders placed on the website www.vraigarcon.com for the purchase of products sold and shipped by VRAI GARÇON PARIS SAS, headquartered at 10 rue de La Paix, registered with the Paris Trade and Companies Register under number 911 451 870.
Unless otherwise stipulated by law, the GTC applicable to the relationship between VRAI GARÇON PARIS and the Customer are those in effect on the date the order is validated.
They apply to the exclusion of all other terms. The contract formed by acceptance of these GTC is governed by French law.
2. PRICES AND PAYMENT TERMS
Vraigarcon.com reserves the right to change its prices at any time, but products will be billed based on the rates in effect at the time the order is confirmed by the customer.
Product prices are listed in euros.
The price of products shipped outside the European Union and overseas territories will be shown excluding taxes on the invoice. In this case, the customer is considered the importer of the products. If customs duties, import taxes, or other fees are due due to the product’s destination, these costs are the responsibility of the customer, who is advised to check and complete the necessary steps before confirming their order.
The full price is payable immediately upon confirmation of the order. Payment is made at the time of ordering by credit card or via the PayPal online payment platform.
The order amount is collected on the same day the order is placed.
3. DELIVERY
The indicated delivery times are in business days.
If the customer makes a purchase as part of a pre-order campaign, payment will be recorded to validate the order and the delivery will occur on the announced delivery date. In the case of an exceptional delay, the customer will be immediately notified by email.
Products are delivered to the delivery address provided by the customer when placing the order. Unless otherwise stated on the website, deliveries are made in France and worldwide.
If the delivery delay exceeds 7 business days for reasons other than force majeure, the customer may cancel the order by sending a registered letter with acknowledgment of receipt to Vraigarcon.com’s customer service, at the company’s headquarters, within 60 business days of the originally scheduled delivery date.
The amounts paid by the customer for the order and shipping costs will be refunded. If the product is received after Vraigarcon.com has received the cancellation, the return shipping costs remain the customer's responsibility, and returns will only be accepted if the products are in perfect condition, with tags and in the original packaging.
Vraigarcon.com accepts no responsibility for delivery delays if an incomplete or incorrect address was provided, or if the recipient was absent or failed to collect the parcel within the allotted time.
In such cases, all reshipping costs are the customer’s responsibility. Lost goods will not be refunded.
Any concern about the condition of the products (e.g., opened or damaged parcel) must be reported to the carrier upon delivery.
Any formal claim for damage or partial loss must also be made to the carrier within three days (excluding public holidays) from the delivery date, by legal notice or registered letter, without affecting the customer's right to take legal action against the seller under the conditions and limits set by law and these GTC.
If there is a significant delivery delay or the products are not received, the customer may contact customer service. An investigation will then be opened with the carrier to locate the parcel. This investigation may take 1 to 3 weeks.
If the parcel is found, it will be immediately reshipped to the address provided at the time of the order. If the parcel is declared lost by the carrier, the products will be reshipped (subject to availability or restocking time) or refunded. No refund or reshipment will be made before the investigation is complete.
4. RIGHT OF WITHDRAWAL
In accordance with articles L.121-20 et seq. of the French Consumer Code, the customer has 14 days from the delivery date to return any new and unworn product, in its original packaging and in perfect condition (suitable for resale). The customer may request a refund without penalty, excluding underwear, which cannot be returned.
The customer must therefore place the item in suitable packaging and return it to us. A copy of the invoice or any other element allowing identification of the order must be included.
5. CONFORMITY
The product photos on Vraigarcon.com are for illustrative purposes only. Customers are invited to refer to the description of each product for precise details.
In case of doubt or for further information, you may contact our customer service via the “contact us” page on our website.
Vraigarcon.com undertakes to refund products that are clearly defective, damaged, or do not match the order.
In this case, the customer must provide a detailed written explanation and return the product(s).
In any case, the customer benefits from the legal guarantees of conformity and hidden defects, in accordance with applicable law.
Reminder of articles L.211-4, L.211-5, and L.211-12 of the French Consumer Code, and articles 1641 and 1648, paragraph 1, of the Civil Code:
Article L.211-4: "The seller must deliver a product that conforms to the contract and is liable for any lack of conformity existing at the time of delivery. This also applies to defects resulting from packaging, assembly instructions, or installation if these were included in the contract or carried out under the seller’s responsibility."
Article L.211-5: "To conform to the contract, the product must:
1° Be suitable for the purpose usually expected of such a product and, where applicable: - match the description given by the seller and possess the qualities presented to the buyer as a sample or model; - have the qualities that a buyer can reasonably expect given public statements made by the seller, producer, or representative, particularly in advertising or labeling;
2° Or have the features defined by mutual agreement or be suitable for any special use sought by the buyer, made known to the seller and accepted by them."
Article L.211-12: "Legal action for lack of conformity must be taken within two years from delivery of the product."
Article 1641 of the Civil Code: "The seller is liable for hidden defects in the item sold that make it unfit for its intended use, or that diminish its use to such an extent that the buyer would not have purchased it, or would have paid a lower price, if they had known."
Article 1648 paragraph 1: "Legal action for hidden defects must be taken by the buyer within two years of discovering the defect."
6. INTELLECTUAL PROPERTY AND COPYRIGHT
All images, texts, layouts, graphics, and fonts on the site are and remain the exclusive property of Vraigarcon.com or the holders of said rights who have granted usage rights to Vraigarcon.com.
They may, however, be used for brand promotion and distribution purposes.
Any reproduction of the designs or representation of the brand without prior authorization will result in legal action.
7. DATA PROTECTION
Customer information and data are strictly necessary for order processing, managing and tracking customer relationships, and for internal statistical purposes.
These data are retained to enhance security, identification, service improvement, and personalization for our customers. A customer or business may request the deletion of their personal data from our records by simple written request.
